BAKERSFIELD, CA - Court documents show Alfredo Moreno, the man accused of driving drunk and killing a six-month-old girl had a blood alcohol level two and a half times the legal limit.
Moreno is charged with one count of first-degree murder, for the death of Layjah Heath.
"My baby was only six months old when she died on her six month birthday," said Donte Heath, Layjah Heath's father. "She didn't have time to live a life. We will never see her again. Her twin sister will never see her again, and that hurts me."
A probable cause statement released Wednesday said on January 19th, Moreno hit a vehicle and injured four people then ran away. It also reveals Moreno shouldn't have been driving because his license is suspended from a previous DUI conviction. The document shows Moreno's blood alcohol was .20 percent, two and a half times the legal limit and that he was driving over the posted speed limit.
While Moreno's attorney, Benjamin Greene, had no comment on these allegations he did say this about the crash.
"Just want to say this is a tragic situation and we offer our condolences and we hope we can resolve this matter shortly," said Greene.
Deputy District Attorney Michael Yraceburn had no comment.
Heath's parents said Monday they forgive Moreno but want this to be a lesson for all.
"It's a nightmare you can't wake up from," said Faith Heath, Layjah Heath's mother. "I try and I pray, but no matter how much I cry, no matter how much I pray, my baby is not coming back."
Moreno is out on bail. So is another man, 26-year-old Joseph Maine, accused of driving drunk and killing a pregnant woman, Vanessa Carrillo.
Maine appeared in court Monday. Documents reveal details about why he is charged with two counts of second-degree murder.
The document said Maine admitted to drinking and driving January 17th with a blood alcohol content twice the legal limit.
Both Maine and Moreno are scheduled to appear in court later this month.
