DUI murder suspect: "I should get the death penalty"

BAKERSFIELD, CA - There are new details from a suspected drunk driving crash that killed a pregnant woman last month. A police report released Thursday shows the accused driver, Joseph Maine, was on his way to get more beer for a party when he crashed.

The police report also shows Maine takes the blame, saying after the crash he "should be arrested and given the death penalty" because he knew better than to drive drunk, causing him to hit and kill Vanessa Carrillo and her unborn child.

It was a night of drinking for Joseph Maine, according to the court documents. Two glasses of wine with dinner, then six beers at a beer pong party, but it all went wrong when Maine and three friends decided to go on a beer run.

The police report shows just before the crash, an officer saw Maine's truck speeding down Fairview Road past Union Avenue at 70 miles per hour, but the officer was unable to stop him because he already had a car pulled over. A few minutes later, the document shows the officer heard the call out for the crash.

Data from Maine's vehicle shows his truck was going about 60 miles an hour a couple seconds before the crash, slowing down to 51 immediately before impact, six to 15 miles over the posted speed limit of 45 miles per hour.

A diagram in the report shows Maine hit the passenger side of the car, where Vanessa Carrillo, 32 weeks pregnant, was riding.

The report said Maine took off his jacket trying to help Carrillo and the others. Officers said in the report that Carrillo initially had a pulse but died waiting for paramedics.

In follow-up interviews Maine said he had a green light, but no witnesses back up his claim. The document shows Maine was arrested for DUI before.

The document said Maine's blood alcohol level after the crash involving Carrillo was .16 percent.

The report shows the driver of the car Carrillo was in was unlicensed but wasn't drunk and was driving ten miles per hour below the speed limit.

The District Attorney office's said it cannot comment on this evidence.

The public defender representing Maine did not return our call.
