Social media privacy bill

BAKERSFIELD, CA- High school senior Oksana Swen has a physical scar on her arm as a result of her emotional experience being cyber bullied.

"I ended up taking it out on myself and I ended up burning love over hate in my arm and cutting my wrist a few times," said Swen.

Swen says she was bullied in middle school and high school. She and her mom Jami Frye think if the school administration had done more to investigate the threats, the situation could have been better.

"If the school is able to look at the pages and their profile then the school will be able to notice anything that's going on where they can get the parent involved if its something serious," said Frye.

Yet the California State Legislature believes a student's right to privacy should not be jeopardized when schools decide to monitor students' social media activity.

Assembly bill 1442 would require schools to only gather and store information that relates to school or student safety, notify parents and students that information is being collected, and to discard any records once the students turns 18.

Kern High School District says they will comply with policy if this bill becomes law.

"If and when AB 1442 is signed, we will seek guidance from the State Board of Education, the Kern County Superintendent of Schools, and the California School Board Association and legal council to make sure that we are in compliance," said Octavio Patino, Kern High School District Spokesperson.

Swen thinks whatever schools can do to reduce bullying and violence within classroom walls and online is necessary.

"I know some students will probably be kind of against it because it's their privacy but it will keep other kids safe," said Swen.

Oksana started her own anti-bullying organization back in 2011 called Student Unite Against Bullying.
