BAKERSFIELD, CA- According to a newly-filed search warrant, the California Highway Patrol is pushing for misdemeanor vehicular manslaughter charges in a fatal crash on Highway 46 on Christmas Day last year.
Sheila Gates, 50, of Watsonville died when the truck she was riding in was struck by a car. The CHP reports a white BMW driven by Xiuying Cui was headed south on Holloway road, when she blew through a stop sign.
CHP officers confiscated Cui's cellphone and asked a judge to mine the phone's data to determine if she was using it at the time of the wreck and may have been distracted.
Officers were also hoping to retreive a crash data box from Cui's vehicle which had been towed to Shafter.
When officers submitted the warrant last month they said they intended to submit a complaint to the District Attorney and recommend charges.
