Bakersfield, CA -- Bakersfield police say no charges will be filed against a 16-year-old girl officers say stabbed a man, while defending her mother this past weekend.
It happened early Sunday in the 7200 block of Three Rivers Drive in southwest Bakersfield.
Police said this morning the 16 year old was defending her mother, who was living with 35-year-old Manuel Hernandez.
Officers said there was a fight between the mother and Hernandez, and the 16 year old stepped in, in her mom's defense.
The mother suffered some injuries during that incident.
Police arrested the 16 year old, but Sergeant Joe Grubbs said today that she will be released from juvenile hall sometime Tuesday.
Monday, 17 News obtained court records that show Manuel Hernandez was arrested and convicted of voluntary manslaughter in 1995.
Eleven years later, Hernandez was arrested again, that time charged with inflicting injury on a spouse, threatening with intent to terrorize and disabling a telephone or power line.
Those charges were dismissed, but Hernandez was convicted of false imprisonment with violence and sentenced to 2 years 8 months in prison.
Police told 17 News again Tuesday that Hernandez remains in critical condition, but is stable.
Police also say Hernandez will likely face charges in Sunday morning's incident.
